Terms and Conditions of Sale
The following terms govern all transactions between
The Book Hut Limited and customers.
1.0 Consumer Guarantees Act 1993
1.1 Where the provisions of the Consumer
Guarantees Act 1993 apply, these terms will be read
subject to the application of that Act, and in the
case of any conflict, the provisions of that Act
will apply.
1.2 Customers agree that where products are
purchased for the purpose of a business the Consumer
Guarantees Act 1993 does not apply.
1.3 Any claim by a customer which is based on
any defect in the quality or condition of a product
or the product’s failure to correspond with
specifications must be notified to The Book Hut
Limited within 30 days of the date of delivery.
Unless notice is received within 30 days of the date
of delivery, the customer is deemed to have accepted
the product as being of merchantable quality,
corresponding with specifications and free of
defects.
1.4 Except as provided by law, all implied
conditions and warranties in respect of the product
are hereby excluded.
2.0 Pricing
2.1 All prices are GST inclusive unless
otherwise stated.
3.0 Payment and Delivery
3.1 With credit card payments The Book Hut
Limited will send the product out to the customer
the day the order is received.
3.2 With Bank Transfers and Cheque payments
The Book Hut Limited will send the product out to
the customer the same day the bank has cleared the
payment.
3.3 The Book Hut Limited does not recommend
that cash be mailed for payment of products. If the
Customer does mail cash, The Book Hut Limited
accepts no responsibility for the theft, loss or
otherwise non-delivery of mailed cash.
3.4 If the Customer chooses to pay for their
purchase via a bank transfer and credits money to an
incorrect bank account number, and the correct
number was provided to the Customer by The Book Hut
Limited then we will not accept any responsibility
for correcting payment and the goods will not be
dispatched.
3.5 If an incorrect delivery address is found
to be an error made by The Book Hut Limited, we will
accept responsibility for the re-delivery,
replacement or refunding of the product. However if
the error is found to be made by the Customer then
The Book Hut Limited will not refund or resend the
product and all responsibility for correcting
delivery will be borne by the Customer.
4.0 Secure Server Information
4.1 To ensure that we provide complete
security for your electronic transactions on our
website we use secure socket layer [SSL] protocol.
SSL uses 128-bit encryption for all personal
information in transit over the Internet, including
your credit card number, name and address. This
technology is designed to protect your information.
To check the security of your connection, look at
the lower right-hand corner of your browser window
after accessing the server. If you see an unbroken
key or a closed lock (depending on your browser),
then SSL is active. You can also double-check by
looking at the URL line of your browser. When
accessing a secure server, the first characters of
the site address will change from "http" to
"https."
5.0 Personal
Information
5.1 All information collected from our
customers is only used for the processing of orders.
We do not release or trade this information to any
other organizations.
5.2 If the customer is an individual, ie: a
natural person, the customer has rights under the
Privacy Act 1993 to access and request the
correction of any personal information which The
Book Hut Limited holds about the customer.
6.0 Law
and Jurisdiction
6.1 All transactions between The Book Hut
Limited and customers are subject to the laws of New
Zealand and the customer submits to the jurisdiction
of the Courts of New Zealand.
